PUBLIC DEBT AS AN INSTRUMENT OF EXTERMINATION IN THE STATE OF EXCEPTION

Abstract

The work aims to expand the concept of state of exception, specifically in the economic field. The hypothesis is that in Brazil the public debt is used to suspend the legal order of the welfare state. The general objective is to analyze the Brazilian public debt. The specific objective is to find out whether the public debt is related to the effectiveness, or suspension, of social rights. We chose the deductive method based on the general premise that is the analysis of the public debt for the specific aspect of the effectiveness of the social rights the population. The conclusion the work clearly demonstrates that it is necessary to disentangle the limited understanding of the scope of the influence of the state of exception, as this is not restricted to the fields of criminal law and criminal procedure, but also to all branches of law, especially the financial and budgetary.
