The FUNDAMENTAL RIGHT TO EDUCATION OF PEOPLE WITH DISABILITIES from a national and international perspective: reflections on school inclusion

This article aims to understand the scope of the constitutional right to education, established not only as a right, but also as a duty of the State, the family and society, to subsequently make an incursion into the theme involving people with disabilities and the difficulties and mishaps of inclusive education. The international and national legislative parameters will be discussed. The method used is the literature review. In the end, it is concluded that for the construction of a society that coexists with differences, more humane and supportive, it is necessary to understand that inclusive education is not only a fundamental human right of all students, but also a true principle of Democratic rule of law, which values the well-being and human dignity of all students, respecting their autonomy and recognizing individual needs and their ability to effectively be included and contribute to society.
